Transfer or acquisition of property in the United States is a long-standing tradition dating back to the original settlements.  From trading goods to enlisting in the Revolutionary war, the way property was transferred or acquired has changed dramatically over the years.  However, one thing has remained consistent, and that is the use of legal documents to complete the transfer and prove ownership.  In modern language, these legal documents are referred to as titles and deeds.  This course aims to educate real estate professionals on the history of the title industry, the purpose and types of titles and deeds, and potential red flags that can occur throughout the sale process.

Learning Objectives

Upon completion of this course, the attendee will be able to:

  • Briefly describe the history of the title industry
  • Define what is a Title and how it relates to real estate transactions.
  • List and define the common legal terms in the real estate Title industry.
  • Understanding the Real Property Law and its relationship to Titles.
  • List and define the common ways in which titles for real property (such as real estate) are created.
  • Explain the basic structure and the four types of Deeds.
  • Differentiate between the Types of Deeds by discussing scenarios where each is used.
  • List and define the common tasks of the registry of deeds
  • List five instrumentalities, other than deeds, that create titles.
  • List and define the principal roles and tasks of a real estate agent in processing Titles and Deeds.
  • List the most common red flags in real estate transactions resulting from Title or Deed Complications.
